FFL Transfer Policy

If you are getting ready to transfer a firearm to us and want to request our FFL (Federal Firearms Licensee)/SOT information

 

We do not provide our FFL/SOT information to anyone other than the shipping FFL (the company you are purchasing from). ffl@toppackdefense.com is where FFL/SOT dealers can reach out to us with a copy of their license and make a request for Top Pack Defenses' licensing. As soon as your firearm is available for pick-up we will contact you at the number provided by the shipping FFL Dealer. 

NOTICE: You will need a valid Wisconsin Driver's License or Wisconsin State ID with your current address. If you do not have your current address on your identification you will need to bring a secondary form of ID from the State or Federal government. Below are the ONLY secondary forms of ID that will be accepted at Top Pack Defense: 

  • Valid Wisconsin Vehicle Registration Permit
  • Vaild Wisconsin Concealed Carry Weapons Card
  • New or Updated Wisconsin Driver's License / Wisconsin State ID (Paper copies given by the DMV are accepted)
  • Military Orders (DD214)

NOTICE: You must be a US Citizen or have a Permanent Resident Card (Green Card) to purchase or transfer a firearm through Top Pack Defense. Unqualifying transfers will be sent back at owners or sellers expense. For any eligibility questions call 608-318-5238 Ext. 1 

 

If you are looking to ship a firearm to another FFL through Top Pack Defense

 

Top Pack Defense does not ship out pre-owned firearms. Purchases made in-store or online can be shipped & transfered to any FFL/SOT lisensee of the customer's choosing (customers will be responsible for the cost of shipping and prepare to pay the intended FFL dealers transfer fees). FFL Transfer Fee (Pistols, Rifles, & Other)

 

Top Pack Defense’s Transfer Fee is $40.00. If you have additional serialized items that are being transfered in the SAME transaction as the first firearm it is only an additonal $25.00 for each item. 

NOTICE: Every inbound firearm requires a transfer fee. If we receive the firearm and then must ship it back due to any reason, including a denied background or a canceled order you are responsible for any additonal costs.

 

NFA Transfer Fee

 

Suppressors, Short Barrel Rifles, & Short Barrel Shotguns are subject to $100.00 transfer fee & $40.00 kiosk fee for suppressors purchased outside of Silencer Shop. If you are not ready to purchase as NFA item, but you would like to set up your accounts and apply your finger prints there will be a $40.00 kiosk fee. Items purchased through Silencer Silencer Shop or in-store are exempt from these fees as long as an NFA item is being purchased at checkout. 

NOTICE: Every inbound NFA item requires a transfer fee. If we receive the NFA item and then must ship it back due to any reason, including a denied background or a canceled order you are responsible for any additonal costs.

Top Pack Defense will not transfer your item unless we recieve an approval notification from the DOJ or NICS system. The Wisconsin DOJ is required to provide an approval or denial response within 7 business days, but NICS does not have to provide a response in a timely manner. Meaning, you may have to come back if your background check expires (30 days) and re-run it until a response is provided. If your background is continuously delayed or expired by NICS, please refer yourself to the FBI Website to consider applying for a UPIN (Unique Personal Identification Number): https://www.fbi.gov/how-we-can-help-you/more-fbi-services-and-information/nics/voluntary-appeal-file

FFL Transfer Denial

 

If you are denied for any reason on your firearm (FFL, DOJ, NICS Background Check) you have 30 days to get a return merchandise authorization (RMA) from the FFL Dealer it came from. If you are filing an appeal you need to inform Top Pack Defense that you are attempting an appeal process and provide proof. 

If you are denied by the FFL and there is no appeal process taking place. You will need to obtain an RMA within 30 days of the denial. If no RMA is obtained by the customer and given to Top Pack Defense after 30 days of the denial, the firearm will be considered abandoned and sent to auction at the customers monetary loss. 

NOTICE: 25% Restocking Fee for DENIED or CANCELED background checks. 

If you are denied by the DOJ or NICS system you have a total of 12 months to complete the appeal process. During the appeal process you will be subject to a $50.00 holding fee per month after your denial notification. If you do not complete the appeal process and your firearm has not been returned with an RMA after 12 months the firearm will again be considered abandoned and sent off to auction.

 

Appeal Proccess

 

All necessary & legal forms will be given to you upon request by the state or federal agencies involved. Top Pack Defense does not provide the appeal applications that resolve any delayed or denied background checks. This summary does not provide legal advice. Wisconsin DOJ Denial (Handgun/Pistol Checks) - Appeal Process:

  • At Top Pack Defense you will receive a yellow form (DJ-LE-FH2). Towards the bottom of the form you will see your  “Nonapproval Number. You will need this information for the Wisconsin DOJ to look you up. 
  • Call the Wisconsin DOJ Firearms Unit at (608) 261-7998. The Wisconsin DOJ will provide you the reason for your denial. Top Pack Defense is not given a reason for “Why” your background check was denied. They will determine if your denial was based on state or federal records (in which you may have to reach out to FBI NICS for federal purposes). 
  • For issues with your background check on a state level you can submit a “Request Record Search Review” & file an appeal through circuit court if you disagree with the result of the DOJ’s review. This appeal must be filed within 30 days of receiving your denial notice. For any additional information on the denial process please, stay on the line or contact the Wisconsin DOJ Firearms Unit at the phone number provided above. 
  • Top Pack Defense has a 25% restocking fee for all denied transactions. They will provide a full refund on items purchased in-store once the issue is fully resolved through the Wisconsin DOJ or FBI NICS appeal process. Firearms that were purchased from another dealer and transferred to Top Pack Defense will be sent back to the original dealer where they will apply their refund policy - no refund will be provided on Top Pack Defense’s transfer fee(s) of $40.00 & $25.00 for any additional items within the same purchase (this covers the shipping & handling).

NICS Denial (Rifle, Receivers, Other Checks) - Appeal Process:

  • To challenge your federal firearm denial, visit https://www.edo.cjis.gov
  • Submit or pursue a Challenge or Voluntary Appeal File to the FBI. This process will provide you a reason you were denied & the opportunity to challenge your denied background check online. Top Pack Defense is not given a reason for “Why” your background check was denied. 
  • If you prefer not to use the online portal, you can mail a letter and the required information to the FBI's NICS Section. When submitting a challenge via mail, include your NICS Transaction Number (NTN) or State Transaction Number (STN). Failure to include these numbers will delay processing. If your Voluntary Appeal File (VAF) is accepted, you will be issued a UPIN (Unique Personal Identification Number). You can provide this UPIN on future applications and firearm purchase forms to help prevent future erred denials or delays.

  • Top Pack Defense has a 25% restocking fee for all denied transactions. NFA Denial (Suppressors & SBR Checks)- Appeal Process:

  • The ATF’s NFA Division will notify you with a letter of your denial & provide you with an FBI NICS Transaction number (NTN). This letter will include the reason for your denial. The denial decision is based on the FBI's National Instant Criminal Background Check System (NICS) information. Meaning, the appeal process is handled by the FBI and not the ATF. 
  • Submit or pursue a Challenge or Voluntary Appeal File - https://www.edo.cjis.gov. You will need to provide your full name, mailing address, and your NTN number. This process will provide you the opportunity to challenge or resolve your denied background check online. 
  • If an appeal is not resloved in one year from the date of the denial and no resubmission attempt has been made, the NFA item will be forfeited from your name. 
  • If you prefer not to use the online portal, you can mail a letter and the required information to the FBI's NICS Section. When submitting a challenge via mail, include your NICS Transaction Number (NTN) or State Transaction Number (STN). Failure to include these numbers will delay processing.   • If your denial was due to an inaccurate or incomplete record, you should gather supporting documentation, such as: Certified court orders showing dismissed, vacated, or expunged charges; documents proving your identity if you were denied due to mistaken identity; or letters proving your rights have been restored. 
  • The FBI will review the denial and the information you provided. They will contact the state or local agencies responsible for the record that caused the denial. The FBI will send you a final determination by U.S. mail. If your denial is overturned or if you've been delayed on multiple transactions, you can apply for a Voluntary Appeal File (VAF).
  • If your VAF is accepted, you will be issued a UPIN (Unique Personal Identification Number). You can provide this UPIN on future background checks and firearm purchase forms to help prevent future erred denials or delays.
